I.1Eligibility

You must be at least 18 years old to purchase any product or application from ORDYNAIRE. By making a purchase, you represent that you are 18 or older and that the information you provide is accurate and complete. The LIMEN application is not directed to children.

I.2No Accounts

ORDYNAIRE does not offer user accounts, profiles, or logins, and the Services do not include forums, comments, messaging, or any other facility for submitting content to us or to other users. Nothing on the Services invites you to post material, and we do not accept unsolicited submissions of ideas, designs, or specifications.

I.3Informational Content Is Not Advice

The Services include descriptions of technologies, engineering approaches, and work ORDYNAIRE intends to pursue. This material is informational. It is not engineering, mechanical, safety, legal, financial, or other professional advice, and it is not a warranty, offer, or commitment that any described product will be produced, released, or made available on any timeline or at all.

Do not rely on informational content when making decisions about the operation, modification, or repair of a vehicle. Consult a qualified professional.

I.4Intellectual Property

The Services and their contents — including the ORDYNAIRE and LIMEN names, logos, branding, design, text, graphics, photography, and software — are owned by ORDYNAIRE LLC and protected by intellectual property law. You may not copy, reproduce, distribute, modify, or create derivative works from these materials, or use ORDYNAIRE branding, without our prior written permission.

Product names and trademarks belonging to vehicle manufacturers or component suppliers are the property of their respective owners. Reference to a vehicle, transmission, or component does not imply any affiliation with, sponsorship by, or endorsement from its manufacturer.

II.1What LIMEN Is

LIMEN is a thermal and clutch monitoring application for the Stellantis 948TE transmission. It reads data made available by your vehicle through a third-party adapter and presents that data to you. The 2022 and newer Ram ProMaster is the platform on which LIMEN has been tested and verified.

II.2Purchase and Licence

LIMEN is sold as a one-time purchase. There is no subscription and no recurring charge. Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use LIMEN on devices you own or control, for your own non-commercial use. You may not reverse engineer, decompile, redistribute, resell, sublicense, or attempt to extract source code from the application, except where that restriction is prohibited by law.

II.3Distribution, Billing, and Refunds

LIMEN is distributed through Google Play. Your purchase is a transaction with Google under Google Play’s own terms of service, and Google — not ORDYNAIRE — is the seller of record and the processor of payment. ORDYNAIRE does not receive or store your payment card details.

Refunds for application purchases are governed by Google Play’s refund policy and are requested through Google, not through us. We will assist where we can, but we cannot issue, approve, or override a Google Play refund. Installation of the application on your device is also subject to your device manufacturer’s and operating system provider’s terms.

II.4Vehicle Safety and Your Responsibility

LIMEN is a monitoring aid. It is not a safety system, a diagnostic authority, a warning device, or a substitute for manufacturer instrumentation, scheduled maintenance, or professional inspection.

You are solely responsible for the safe operation and maintenance of your vehicle. Do not interact with the application while driving. Do not rely on LIMEN to detect, prevent, or warn you of a mechanical fault, an overheating condition, or any other hazard. The application may display values that are delayed, incomplete, inaccurate, or absent, including because of adapter behaviour, connection loss, vehicle bus conditions, device performance, or software error.

ORDYNAIRE is not responsible for any decision you make in reliance on data displayed by LIMEN, or for any damage to a vehicle, transmission, or other property, or any injury, arising from such reliance.

II.5Third-Party Hardware

LIMEN requires a third-party adapter to communicate with your vehicle. ORDYNAIRE does not manufacture, sell, endorse, or warrant any adapter, and is not responsible for the performance, compatibility, safety, or effect on your vehicle of hardware supplied by others. Use of a diagnostic adapter may affect your vehicle’s systems or its manufacturer warranty; that risk is yours.

II.6Updates and Availability

We may update, modify, suspend, or discontinue the application, or any of its features, at any time. We do not guarantee that LIMEN will remain compatible with any particular vehicle, transmission, adapter, device, or operating system version, or that it will be available without interruption or error.

III.1Orders and Acceptance

A product listing is an invitation to order, not a binding offer. Your order is an offer to buy, and no contract is formed until we accept it by dispatching the goods. We may decline or cancel any order, including after an acknowledgement has been sent, and including where a product is unavailable or a price or description was published in error. If we cancel a paid order, we will refund the amount charged.

III.2Pricing, Payment, and Taxes

Prices are in United States dollars and may change without notice. Prices exclude shipping and applicable sales tax unless stated otherwise. Payment is processed by a third-party payment processor under its own terms and privacy policy; ORDYNAIRE does not collect or store full payment card details.

III.3Shipping, Title, and Risk

Shipping estimates are estimates, not guarantees, and we are not liable for carrier delays. Title and risk of loss pass to you on delivery to the carrier. Inspect your shipment on arrival and notify us promptly of visible damage or a shortage so we can help you pursue a claim.

III.4Returns

Unless a written return policy published at the point of sale provides otherwise, returns are accepted within 30 days of delivery for products that are unused, uninstalled, and in original packaging, and require a return authorisation obtained by contacting us first. Return shipping is your responsibility unless the product is defective or was sent in error. Products that have been installed, modified, or subjected to heat, fluid, or fastener torque are not returnable. Refunds are issued to the original payment method after inspection.

III.5Fitment, Installation, and Vehicle Warranty

Fitment information is provided in good faith and is your responsibility to verify before purchase and before installation. We recommend installation by a qualified technician. Improper installation, or installation of a part not suited to your specific vehicle, may cause damage, injury, or failure for which ORDYNAIRE is not responsible.

Installing aftermarket parts may void or limit your vehicle manufacturer’s warranty. Confirm the effect on your warranty before proceeding. ORDYNAIRE is not responsible for warranty coverage denied by a manufacturer or dealer.

III.6Regulatory Compliance and Off-Road Use

Some products may be sold for off-road, competition, or exhibition use only and may not be legal for use on public roads in your jurisdiction. Where a product carries such a designation, it is stated in the listing, and you are responsible for compliance with all applicable federal, state, and local law, including emissions and equipment regulations. It is your responsibility to determine whether a product is legal for your intended use. ORDYNAIRE accepts no liability for use of a product in violation of law.

III.7Product Warranty

Unless a written warranty is expressly provided with a product, products are sold without warranty from ORDYNAIRE beyond any warranty offered by the original manufacturer, which passes to you where transferable. Any warranty is void where a product has been misused, raced, overloaded, improperly installed, modified, or subjected to conditions beyond its rated use. Consumable and wear items are excluded.

IV.1Disclaimer of Warranties

Except as expressly stated in these Terms or in a written warranty provided with a product, the Services and all products are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, error-free, or that any information presented is accurate or complete.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

IV.2Limitation of Liability

To the maximum extent permitted by law, ORDYNAIRE LLC and its members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, use, or goodwill, arising out of or relating to the Services or any product, whether based in contract, tort, strict liability, or otherwise, even if advised of the possibility of such damages.

To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Services or a product will not exceed the greater of the amount you paid to ORDYNAIRE for the product or application giving rise to the claim, or one hundred United States dollars ($100).

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

IV.3Assumption of Risk

Motor vehicle operation, modification, maintenance, and performance use are inherently hazardous. You knowingly and voluntarily assume all risk arising from your use of ORDYNAIRE products and from any decision informed by the LIMEN application, including risk of property damage, mechanical failure, injury, and death.

IV.4Indemnification

You agree to indemnify, defend, and hold harmless ORDYNAIRE LLC and its members, officers, employees, and agents from any claim, damage, loss, liability, or expense (including reasonable attorneys’ fees) arising out of your use of the Services or any product, your installation or operation of a product, your violation of these Terms, or your violation of any law or third-party right.

IV.5Changes to the Services and These Terms

We may modify, suspend, or discontinue any part of the Services at any time. We may also update these Terms; when we do, we will revise the “Last updated” date above. Changes take effect on posting, and your continued use of the Services constitutes acceptance. The Terms in force at the time of an order govern that order.

IV.6Governing Law and Disputes

These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-law rules. You and ORDYNAIRE agree to the exclusive jurisdiction of the state and federal courts located in Colorado for any dispute arising from these Terms, the Services, or a product.

Before filing a claim, you agree to contact us and attempt in good faith to resolve the matter informally.

IV.7Severability and Entire Agreement

If any provision of these Terms is found unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions will remain in full effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with our Privacy Policy and any written policy published at the point of sale, are the entire agreement between you and ORDYNAIRE regarding the Services.
